1. Introduction

These Terms and Conditions (“Terms”) govern the provision of Vtuber Model Creation Services (“Services”) by MyVtuber (“we,” “our,” or “us”) to you (“Client,” “you,” or “your”). By purchasing our Services, you agree to be bound by these Terms.

2. Scope of Services

MyVtuber specializes in creating custom Vtuber models, rigging, and related digital assets according to your specifications. Specific deliverables, timelines, and pricing will be outlined in your order or agreement.

3. Client Responsibilities

  • You agree to provide accurate information, references, and approvals required for the creation of your model.
  • You will review drafts, previews, or test files we send and provide timely feedback to ensure the project stays on schedule.

4. Approvals, Revisions & Workflow

  • MyVtuber provides unlimited revisions at each stage of the process until you are satisfied.
  • However, once a stage is approved and we proceed to the next stage (for example, moving from design to rigging), it is not possible to return to a previous stage without incurring extra charges.
  • Revisions are limited to the current stage of work and the approved scope in your order. Additional changes outside this scope may incur extra charges.

5. Refund Policy

  • No Refund After Final Delivery
    • Once the complete and final Vtuber model files have been delivered to you, no refunds will be issued under any circumstances.
  • Approval-Based Workflow
    • Each stage of the project (concept, design, rigging, etc.) requires your approval before we move forward. By approving a stage, you confirm that you are satisfied with the work completed so far.
  • Deposits Are Non-Refundable
    • Any deposit or advance payment made to start the project is non-refundable, as it secures your slot and covers initial work.
  • Refund Eligibility Before Work Starts
    • If you cancel before any work has begun (and before any files or drafts are shared), you may be eligible for a partial refund of the amount paid, excluding the non-refundable deposit.
  • Partial Refunds for Early Cancellation
    • If you cancel after work has started but before final delivery, MyVtuber may issue a partial refund at its discretion, based on the percentage of work already completed.
  • No Refund for Misuse or Third-Party Issues
    • We are not responsible for problems caused by third-party platforms, software, or improper use of the delivered files. Refunds will not be granted for such issues.
  • Final Delivery Change Window
    • After the final product has been delivered, you may request minor changes within 2 days. Changes requested after this period will not be accommodated, and refunds will not be issued under any circumstances.
  • Refund Processing Time
    • Any approved refund will be processed within approximately 6–7 business days and returned via the original payment method.

6. Delivery

We will deliver the final files via the method agreed upon (e.g., email, download link, or cloud storage). You are responsible for securely storing your files after delivery.

7. Intellectual Property

  • Upon full payment, you will receive the rights to use the Vtuber model as outlined in your order (personal or commercial use).
  • MyVtuber retains the right to display the work in our portfolio unless you request otherwise in writing.

8. Payment Terms

  • Payment must be made according to the invoice schedule provided.
  • Work will commence only after the initial payment or deposit has been received, unless otherwise agreed.

9. Limitation of Liability

MyVtuber is not responsible for any indirect, incidental, or consequential damages resulting from the use of the delivered files or services.

10. Governing Law

These Terms will be governed by and construed in accordance with the laws of the United States of America and applicable laws of European countries including the United Kingdom, without regard to conflict of law principles.
